The longest running case in Malaysian legal history of Irene Fernandez, Director of Tenaganita will begin the appeal hearings from April 1 - 10, 2008 at the Criminal Court 1, High Court, 5th Floor, Jalan Duta, at 8.30am.
Irene Fernandez was charged under the Printing Presses and Publication Act for publishing false news in March 1996 for her expose of the dehumanizing conditions in Immigration Detention Centers through a Memorandum entitled "Abuse, Torture and Dehumanized Conditions of Migrant workers in Detention Centers" in July 1995.
After seven years of trial, on October 16, 2003, Irene was sentenced to twelve months imprisonment by Magistrate Juliana Mohamed at the Magistrates Court in Irene then immediately made an appeal to the High Court and for a stay of execution of the sentence. She has been out on bail with her passport impounded by the courts since the sentence. .
The appeal at the High Court has taken five years for the first hearing to take place. The appeal on the sentence will be heard by Yang Arif Hakim Dato' Haji Mohamad Apandi Bin Haji Ali and Irene will be represented by Mr. M Puravalen and Ms. M. Moganambal.
